Privacy Policy

 

1 Introduction

When you use Acendy products, personal information about you is processed. This privacy notice is designed to help you understand what personal data is collected, why it is collected and how Acendy handles, protects, stores, exports and deletes your personal data.

Personal data is any information relating to an identified or identifiable natural person such as an email address, address, phone number, etc.

The Privacy Statement is reviewed at least annually, last updated: July 18, 2025.

Using the application (aka: the Acendy e-commerce platform).

Before you can use our application, you must first register. To do so, you provide an email address and choose a password to secure your account. With that we will then create an account, which you can log into with the email address and password of your choice. In your account you can complete your profile with various personal data. These are used to provide our services. For example, to provide invoices to your customers with your store information, to receive payments, to answer your support questions, and to send service messages to the email address you provide.

If you have chosen a paid subscription, we also use your personal information to process payment and issue an invoice.

2. Acendy as processor

For the personal data you enter into the Acendy application and that is processed there, your employer is the data controller. Acendy does act as a Processor in those cases and processes the data on behalf of and according to instructions from the employer.

If you have requests for deletion of your personal data, correction of personal data or insight into what personal data about you is being processed, you should contact your employer.

3. Acendy as Controller

In most cases Acendy is the data controller of your personal data. This is the case when Acendy determines the purpose and means of processing personal data, for example for application improvement, support, marketing and security purposes.

4. Information about the processing of personal data where Acendy is the Controller


4.1 What personal data do we process?

The types of personal data Acendy processes with respect to you may include the following:

  • Basic personal information such as name and address, (billing) address, phone number, email address, payment information and demographic information
  • Information related to user and web traffic such as login information, username and IP address
  • Statistics showing how users use our software and consume content provided by us
  • Financial information such as information related to invoices
  • Content you uploaded or provided such as photos, comments, articles and videos
  • Information provided in job applications

For the purposes listed in the "Why we process personal data" section, Acendy does not process sensitive personal data about you.



4.2 How is personal data collected?

In general, Acendy collects personal data directly from you or from other individuals connected with you. If you purchase Acendy products or services through an Acendy partner company, we may collect information about you from the partner company.

We also use cookies and other tracking technologies when you use our applications/services to optimize your experience with Acendy and our products.

4.3 Why do we process personal data?

This Privacy Statement applies when Acendy processes your personal data for various purposes when you interact with us, such as:

Buying and delivery

  • Creating and facilitating accounts for users of our services.
  • Providing customers with requested offers for products and services
  • Facilitating customer orders and payments
  • Offering services directly to you, such as paid services

Support and improvement

  • Improve and (further) develop the quality, functionality and user experience of our products, services and Acendy's websites
  • Provide customer support for our products and services

Security

  • Detect, fix and prevent security threats and misuse, perform maintenance and debugging activities

Marketing

  • Manage marketing preferences and send marketing content
  • Creation of interest profiles to promote relevant products and services (profiling)

Analysis

  • Analyzing data to improve our marketing activities and/or services
  • Collecting feedback. We constantly strive to improve our service based on information and feedback we receive from you.

Recruitment

  • Managing recruitment processes and processing job applications.
  • Reviewing submitted documents, conducting interviews and requesting references


Information on how personal data is processed in any of our many services is outlined in the respective data processing agreement for that service. In such cases, Acendy acts as a data processor and processes the data on behalf of and according to the instructions of the customer. For more information on this, please contact the customer service for that particular service.

 

4.4 What is the legal basis for processing your personal data? We process data based on several legal grounds.

Acendy has a legitimate interest when we process your data for security, support, marketing, analysis and improvement purposes. Your personal data is processed from a business perspective in a way that we do not believe violates your privacy rights or freedoms.

4.5 How is your personal data shared?

Acendy may share your personal data with external third parties in the following contexts:

Business partners
Acendy may share your personal data with our partners in the event this is justified from a business perspective and in compliance with applicable privacy laws.

Government authorities
Police and other authorities may request access to Acendy's personal information. In these cases, Acendy will only provide the data if there is a court order etc. to do so.

4.6 Use of Processors

When using Processors, Acendy will enter into a processor agreement to safeguard your privacy rights. If Processors are located outside the EU/EEA, Acendy will ensure legal grounds for such international transfers on your behalf, below by using the EU Model Clauses.

The parties we require for the performance of the agreement are:

  • Our IT and payment service providers;
  • Administrative service providers;
  • Communication software providers;
  • E-mail platforms;
  • API partners (only the companies whose links you have set up).

4.7 How long will your data be kept?

Acendy does not store your personal data for longer than necessary for the purpose of processing. We retain this information for up to three months after you delete your account and/or cancel your subscription. We store some of this data up to ten years after cancellation (due to legal tax retention requirements).

4.8 What are your rights?

You can invoke the following rights in relation to our processing of your personal data:

  • Access. You have the right to request a copy of the personal data we process about you.
  • Rectification: You also have the right to request Acendy to rectify inaccurate personal data relating to you. If you have an account with Acendy , you can usually do so through the appropriate "your account" or "your profile" sections on the applicable Acendy site or service.
  • Deletion. You may request that Acendy delete personal information relating to you.
  • Restriction. You may ask us to restrict the processing of your personal data.
  • Transferability. You may ask us to provide you or others with your personal data in a structured, commonly used and machine-readable format.
  • Objection. Based on your specific situation, you have the right to object to the processing of your personal data based on legitimate interests or for direct marketing purposes. You also have the right to object to our processing of your personal data for the performance of tasks carried out in the public interest or in the exercise of public authority or on the basis of legitimate interests.

Please note that certain exceptions or limitations to the above rights may apply depending on the specific circumstances of your situation. In such cases, we will provide you with detailed information about the applicable exception or limitation and help you exercise your rights to the fullest extent possible, in accordance with applicable laws and regulations.

If you feel that we are not helping you in the right way, you have the right to file a complaint with the regulator in the country where you are located. In the Netherlands, this is the Authority Persoonsgegevens.

4.9 Marketing and profiling

As part of the use of the application, Acendy will process your personal data on the basis of legitimate interest. One of Acendy's legitimate interests is the processing of personal data for direct marketing purposes.

Acendy uses your personal data to offer you relevant content through direct marketing on social media platforms and emails, web pages or in an Acendy service, based on your preferences. The personal data processed is aggregated data about you such as IP address, interests (where you clicked, etc.), username and device. This is done through technologies such as cookies and is called profiling. 

Acendy uses email as a means of communicating marketing, but only if you have given consent in accordance with national marketing laws (if required). If you have given consent, you always have the option to opt-out as described below, or when you receive an email with marketing.

You have the right to opt out of receiving marketing communications from Acendy and be subject to profiling. You can do this by following the opt-out instructions in the relevant marketing communication.

Please note that even if you opt out of receiving marketing communications, you may still receive administrative communications from Acendy, such as order confirmations and notifications necessary to manage your account or the services provided to Customers.

We value your opinion. If you have comments or questions about our Privacy Statement, or if you have any concerns about your privacy, including regarding a possible breach of your privacy, please send them to support@acendy.nl.

We will treat your requests or complaints confidentially. Our representative will contact you to discuss your concerns and outline options as to how they can be resolved. We strive to ensure that complaints are resolved in a timely and appropriate manner.
